1. General provisions

1.1 This Privacy Policy (hereinafter referred to as the "Policy") is developed by
TM Namomenti in accordance with the current legislation of Ukraine, including the Law of Ukraine "On Personal Data Protection" regarding the Users of the website https://namomente.ua and establishes the procedure for obtaining, collecting, accumulating, storing, processing, using, ensuring the protection and disclosure of personal data (hereinafter - "Data") of Namomenti Users.

Data means any information relating directly or indirectly to a particular User (in accordance with clause 2 of this Policy).

Data processing means any action with the Data, including, but not limited to: access, provision, distribution, collection, systematization, storage, accumulation, recording, transmission, blocking, deletion, clarification, updating and/or modification, depersonalization.

The data manager is Namomenti.

1.2. Users may provide data independently by posting it on the website or by sending it via telephone, e-mail and/or postal address of the website, or data may be provided from other sources (in accordance with clause 3 of this Policy) or other information from third parties provided in the course of sending claims, complaints and/or disputes, and/or information from publicly available sources on the Internet.

1.3. The User shall not use the website https://namomente.ua if he/she does not agree to the terms of this Policy.

2. Collected data

Namomenti may collect such data:

• name, surname, contact numbers, e-mail address and other communication data at the request of the User;
• information about the User's account is necessary for the provision of services and communication with the Users, including when the User contacts the support service;
• data about the devices used by the User or their mobile Data (in case the User uses the mobile application) such as: ip-address, date and time when the User uses Namomenti, information about the software, browser, information about the operating
• mobile device system, information about the operation of the User's devices, individual device identifiers used by the Users;
• data obtained as a result of various Namomenti surveys related to improving the provision of services to Users;
• information obtained as a result of marketing activities;
• information posted by Users based on the results of their service, reviews, comments, requests for support, complaints, claims, etc.

The data is processed using the following technologies:

• Cookies (cookies are a piece of data that is sent to the user's computer when they go to a web page and/or view an advertising module on a web page and stored on the user's computer and/or mobile device);
• pixels allow us to track the frequency of the User's use of web pages in order to determine their browser, provide services, and to eliminate errors of https://namomente.ua initiated by the User. The collected information is processed in its original form and is not changed during the data collection process.

3. Data processing purposes

Namomenti uses and processes Data for:

• performing its functions, powers and duties in accordance with the current legislation of Ukraine, as well as ensuring the implementation of civil, economic and tax relations;
• to identify the client as a Namomenti User for the purpose of further communication (provision of services, payment processing, sending, conducting settlement operations, keeping records, analyzing activity, managing traffic, analyzing the interests of Users, publishing reviews).

4. Use of personal data

Namomenti does not process Data on race, nationality, political views, religious and other beliefs, membership in public associations.

Information characterizing the physiological characteristics of the Users, on the basis of which it is possible to establish their identity, is not processed.

The terms of Data processing and storage are determined based on the purposes and conditions specified in the agreements concluded with the Users in accordance with the requirements of the current legislation of Ukraine.

5. Conditions for granting access to data

In order to demonstrate the effectiveness of the Namomenti website and improve the image of the website, Namomenti may disclose website statistics without disclosing personal data or information that is a commercial secret.

The Namomenti website may contain links to third-party web resources when Users navigate to them, which are not covered by this Policy.

The Website processes data on a lawful and fair basis. The data is not disclosed to third parties and is not distributed without the consent of the User, except as provided by the current legislation of Ukraine and only in the interests of national security, economic welfare and human rights, in particular, but not exclusively:

• upon reasonable requests from government agencies that have the right to request and receive such data;
• if, in the opinion of https://namomente.ua, the User violates the terms of this Policy and/or other contracts and agreements concluded between Namomenti and the User, as well as the provisions of the User Agreement, the Rules for Posting Information on the Website, the Rules for Publishing Reviews.

Namomenti reserves the right, in accordance with the requirements of the current legislation of Ukraine, to exchange Data with government agencies in order to: prevent fraud, resolve disputes and clarify circumstances that may be/cause a violation of applicable law, as well as in case Namomenti detects illegal actions of Users and/or receives claims, complaints, appeals from third parties.

6. Change or delete data

At any time, Users can make changes to their personal information or unsubscribe from the newsletter, or withdraw their consent to the processing of Data by sending a message to [email protected].

Upon receipt of the notification, the processing of the User's Data will be terminated and the information will be deleted, except as may be required in accordance with the current legislation of Ukraine.

Namomenti processes and stores data for the purposes described in this Policy for the entire period necessary for this purpose.

7. Data protection

When processing the Data, Namomenti shall take all necessary technical, organizational, legal measures to protect the Data from unauthorized and/or unauthorized access to such Data, including modification, deletion, provision, distribution and other illegal actions.

Namomenti monitors the security measures taken on an ongoing basis.

8. Additional terms and conditions

Namomenti reserves the right to change the terms of this Policy at any time. In this case, the updated version will be posted on the website. In case the User does not agree to the changes, he/she undertakes to immediately cease any interaction with Namomenti.

The Namomenti website is not responsible for any losses or damages incurred by the User or third parties as a result of misunderstanding or misunderstanding of the terms of this Policy.

In the event that any provision of this Policy, including any proposal, clause or part thereof, is recognized as contrary to the current legislation of Ukraine or invalid, this will not affect the other provisions, they shall remain fully in force and continue to be in full force and effect, and any invalid provision or provision that cannot be fulfilled, without further action by the Parties, shall be deemed amended, corrected to the extent necessary to ensure its validity and enforceability.

The terminology used in this Policy has the same meaning as in the User Agreement, unless otherwise specified.
